The SC rejected DK Shivakumar's appeal contesting the CBI FIR.

New Delhi: Karnataka Deputy Chief Minister D K Shivakumar suffered a defeat on Monday when the Supreme Court denied his petition contesting the CBI's FIR against the Congress politician in the case of disproportionate assets. A bench consisting of Justices Bela M. Trivedi and Satish Chandra Sharma said that they have no intention of overturning the Karnataka High Court's ruling.

"I apologize. Rejected," the bench declared.

Senior attorney Mukul Rohatgi, representing Shivakumar, stated at the beginning of the hearing that the inquiry into the case had begun without the necessary authorization under Section 17A of the Prevention of Corruption Act.

According to Rohatgi, as the Income Tax (IT) department is already looking into the transaction, a CBI FIR cannot be filed for the same transaction.

But the bench turned down the request to discuss it.

Shivakumar filed a plea with the supreme court challenging its October 19, 2023 ruling that had denied it. The plea was being heard by the court.

The Central Bureau of probe (CBI) was given a three-month deadline by the high court to complete the probe and submit the report.

Between 2013 and 2018, Shivakumar allegedly accumulated assets that were out of proportion to his known sources of income, according to the CBI. During this time, he served as a minister in the preceding Congress administration.

On September 3, 2020, the CBI filed the FIR. In 2021, Shivakumar filed a high court challenge to the FIR.

In 2017, Shivakumar's offices and apartment were subjected to a search and seizure operation by the IT department. This led to the opening of an investigation by the Enforcement Directorate (ED) into the matter.

The CBI requested permission from the state government to file a formal complaint against him based on the findings of the ED inquiry. The state administration approved the sanction on September 25,2019 and the FIR was filed a year later.
