NHRC notifies HR government and DGP on patient's "wrong knee" surgery

The NHRC noted in a statement released on Thursday that the patient was charged by the hospital even though they were eligible for Ayushman - Bharat Pradhan Mantri Jan Arogya Yojana, based on a media report.

The National Human Rights Commission has taken "suo motu cognisance of a media report that a patient was wrongly operated upon his left knee, instead of the injured right knee at a hospital in Panipat" .

The patient's family reportedly objected, so the physicians operated right away on the other knee, but the patient is reportedly unable to walk as a result. The hospital withheld his Ayushman Bharat card and charged him ₹8,000, according to the statement.

If the news report's contents are accurate, the Commission has noted, they raise severe concerns about "medical negligence causing violation of the victim's rights to life and health."

In light of this, it has sent letters to Haryana's director general of police and chief secretary, requesting a thorough report in a week. It stated that information about the measures taken against the guilty and any compensation given to the sufferer should be included.

According to the NHRC, "The authorities who have failed to do their duty to supervise and keep vigil on such private hospitals cannot escape their liability, where the patients are being exploited and subjected to cruelty as well as being treated in an inhuman manner."

The media report stated that the man had been working as a laborer to support himself since he lost his family in an accident in 2006. According to the statement, he fell while cleaning his residence and hurt his right knee.
