A vacation bench of the Supreme Court noted on Monday, while considering Delhi Chief Minister Arvind Kejriwal's appeal against an interim stay on his release, that stay orders are typically not reserved and issued the same day.

The bench, which is made up of Justices SVN Bhatti and Manoj Misra, stated that it would prefer to wait for the high court's decision to be made.

Judge Misra declared that he would await the Delhi High Court's ruling on the Enforcement Directorate's application for a stay of a trial court-granted bail for Arvind Kejriwal.

It's not like this, he said.

On Sunday, Kejriwal filed a case with the Supreme Court after the High Court withheld his release pending the court's decision.

Today, the Supreme Court informed Abhishek Manu Singhvi, Kejriwal's attorney, that making any decisions at this time would be prejudicial.

"If we pass any orders at this point, we will be making prejudgments about the matter. The bench informed Singhvi that it is the high court and not some other court.

The hearing was subsequently postponed until June 26.

Singhvi has requested the bail order's temporary stay be revoked.


According to the attorney, Kejriwal ought to be freed till the Delhi High Court issues a ruling. The chief minister of Delhi, he remarked, is not a flight risk.

"I am aware of what I'm asking. Just as the high court had stayed the bail order upon the Enforcement Directorate's mere mention, this court must stay the high court order before it is pronounced," he argued.
